AgentWerks AI – Beta Program Terms of Service
These Beta Program Terms of Service ("Terms") govern your participation in the AgentWerks AI beta program ("Beta Program"). By accessing or using the beta software, services, or related materials (collectively, the "Beta Services"), you agree to these Terms.
If you do not agree, do not participate in the Beta Program.
1. Beta Program Status
The Beta Services are provided on a pre-release, experimental basis. They may contain bugs, errors, or incomplete features and may change materially or be discontinued at any time without notice.
You acknowledge that:
- The Beta Services are not production-ready
- Availability, performance, and functionality are not guaranteed
- Data loss, corruption, or unexpected behavior may occur
2. Eligibility
You must be at least 18 years old and have the legal authority to agree to these Terms on behalf of yourself or your organization.
Participation is by invitation or approval only and may be revoked at any time.
3. Acceptable Use
You agree to use the Beta Services only for lawful purposes and in accordance with these Terms.
You may not:
- Use the Beta Services for illegal, abusive, or harmful activities
- Attempt to reverse engineer, decompile, or extract source code or models
- Circumvent security, rate limits, or access controls
- Use the Beta Services to build or train competing products
- Share access credentials or grant unauthorized access
4. Confidentiality
The Beta Services, including features, workflows, documentation, designs, and non-public information, are considered confidential.
You agree not to:
- Publicly disclose beta features or internal behavior
- Share screenshots, recordings, benchmarks, or documentation without permission
- Publish reviews or comparisons without prior written consent
This obligation survives termination of your beta access.
5. Feedback
You may provide feedback, suggestions, or ideas ("Feedback") regarding the Beta Services.
By providing Feedback, you grant AgentWerks AI a non-exclusive, perpetual, royalty-free license to use, modify, and incorporate that Feedback into current or future products without obligation or compensation.
6. Data and Privacy
You retain ownership of your data.
However, you acknowledge that:
- Beta Services may log prompts, outputs, metadata, and usage patterns
- Data may be reviewed to improve system quality, safety, and performance
- Data handling practices may evolve during the beta period
Do not submit sensitive, regulated, or confidential production data unless explicitly approved in writing.
7. Intellectual Property
All intellectual property rights in the Beta Services—including software, models, workflows, branding, and documentation—remain the exclusive property of AgentWerks AI.
These Terms do not grant you ownership or license rights beyond limited beta access.
8. No Warranties
THE BETA SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGENTWERKS AI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY OF OUTPUTS
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
AgentWerks AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business interruption, arising from or related to your participation in the Beta Program.
Total liability shall not exceed $100 USD.
10. Termination
AgentWerks AI may suspend or terminate your access to the Beta Services at any time, with or without cause or notice.
You may stop participating at any time by discontinuing use.
Upon termination:
- Your right to access the Beta Services ends immediately
- Confidentiality and IP provisions remain in effect
11. Future Availability
Participation in the Beta Program:
- Does not guarantee access to future releases
- Does not imply pricing, feature commitments, or support obligations
- Does not create a partnership, employment, or agency relationship
12. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
13. Changes to These Terms
We may update these Terms from time to time. Continued participation in the Beta Program after changes become effective constitutes acceptance of the updated Terms.
